Attorney General Merrick Garland has assigned the U.S. attorney to review the around ten classified documents which were discovered in the cabinet of former President Joe Biden, CBS News reported on Monday.

The classified documents are from Biden's vice president's office in the Penn Biden Center for Diplomacy and Global Engagement located in Washington, very close to Capitol Hill.

The classified documents were discovered by Biden's personal lawyers just days prior to the midterm elections on November 2, according to the Special Counsel to the president, Richard Sauber.

Sauber stated that his White House “is cooperating with the National Archives and the Department of Justice regarding the discovery of what appear to be Obama-Biden Administration records.”

When Biden's lawyers found these documents, they informed Biden's attorneys and notified the National Archives, who reportedly sent the case to the U.S. Department of Justice (DOJ) and led to Garland's appointment of U.S. Attorney John Lausch to examine the way in which the classified documents ended up in Biden's former office.

    Sauber said:

“The President frequently utilized this space from mid-2017 through the campaign in 2020. On the day of the discovery, on November 2, 2022 the White House Counsel's Office notified the National Archives. The Archives were able to take possession of the material the next day.”

The discovery of the documents was made by the lawyers for the President. The documents weren't the subject of any prior request or inquiry made by the Archives. Since their discovery, the president's personal attorneys have been cooperating with the Archives as well as the Department of Justice in a procedure to ensure that all Obama-Biden Administration records are appropriately kept in the Archives.

They were reported to be in a file that was inside a box that contained other materials that were not classified as per CBS News.

But CBS News' sources didn't confirm the level of classification these documents had been classified at, nor what they contained.
